The National Labor Relations Board ambush election rule took effect April 30 and the NLRB¡¯s General Counsel has issued guidance on implementation. The regulation will reduce the time frame for union elections to as short at 17-20 days and limit the issues that are addressed in pre-election hearings. The Board has also revoked the recommendation that elections not be scheduled sooner than 25 days after it has been directed to take place by the NLRB regional director. IFDA has challenged the regulation in Federal District Court through the Coalition for a Democratic Workplace, but we are still awaiting a ruling and the judge has refused a request for an injunction. Information on the guidance and a summary from IFDA legal counsel is available on IFDA¡¯s Regulatory Watch. If you are an IFDA member and would like more information, please contact the IFDA government relations department.
