A federal district court judge in the District of Columbia has found that the NLRB¡¯s ambush election rule was improperly instituted and overturned the regulation in a ruling released yesterday. The judge held that the Board published the regulation without a properly constituted quorum of three Board members participating in the decision because the only Republican Board member at the time, Brian Hayes, did not actually vote prior to the release of the rule. The Supreme Court has previously ruled that the Board requires three members to constitute a legal quorum and the judge found that although Member Hayes participated at various points in the process, he did not actually vote on the final approval and therefore the rule could not stand. The legal challenge was brought by the Coalition for a Democratic Workplace (CDW), a coalition of more than 600 business organizations. IFDA is a founding member of CDW and sits on the management committee.
