The Food and Drug Administration has sent letters stating that it will not begin enforcing certain provisions of the Food Safety Modernization Act due to take effect July 4 until final rules are enacted. The law states that the hazard analysis and preventive controls requirements are effective 18 months after enactment with additional provisions taking effect early next year. FDA has yet to put out regulatory proposals to implement these requirements, however, and the letters detailed that the agency will base enforcement on the timeframes contained in the final rules. The proposed rules are currently under review at the White House and the timetable for their release is unclear. Final rules would then likely take at least an additional year. An E-Alert providing additional information from IFDA¡¯s food safety counsel at Covington is available here.
